What is the beckham law

 The "Beckham law", as it is commonly known, regulates the procedure that applies to the new Spanish tax regime for expatriates in force since 1 January 2004.


What is the Beckham Law in Spain 2025?

The Spain “Beckham Law,” also known as the Special Expat Regime Tax, or the Special Tax Regime for Inbound Worker is a tax incentive for foreign workers who move to Spain for employment. Under this regime, eligible individuals are taxed as non-residents for Spanish tax purposes, even though they live in Spain.


Who can apply for Beckham law?

As you have seen up to this point, the application of this law translates into a great advantage and into a very effective method to save money.

So, what are the requirements one must meet in order to apply for the Beckham Law?

  • Not to have lived in Spain during the past 10 years
  • You must have come to Spain for work purposes. That is, you have received a job offer (which you got before entering the country), you have been transferred from a foreign company to Spain or you become the director of a company located in the country (in which you do not own more than 25% of its shares)
  • All working responsibilities and tasks must be performed in Spain. If part of these are performed abroad, they cannot represent more than 15% of the total activity of the employee
  • You do not receive income that would qualify as obtained from a permanent establishment located in Spain. Thus, the hiring company must be Spanish.
  • You apply for the application of this regime up to 6 months after the beginning of the employment relationship that has brought you to Spain
  • You hold a residence permit for remote work (known as a digital nomad visa) by being an employee of a company based abroad (freelancers do not qualify)
  • You are a family member of a foreigner with a residence permit as a digital nomad
  • You come to Spain to provide services or R&D training to start-ups and emerging companies as a highly qualified worker (as long as a minimum of 40% of your turnover comes from these activities).

But it is not all good news. The following three groups of foreigners CANNOT apply for the application of this regime:

  • Freelancers or self-employed workers
  • Sportsmen and professional athletes
  • Directors of companies located in Spain of which they own more than 25% of the equity


What is the minimum salary for the Beckham Law.

While the minimum salary requirement is generally €58,000 per year, the Beckham Law often benefits high-earning professionals such as executives, managers, and specialists in various sectors, including technology, finance, and other industries.


How to obtain Beckham Law

Below you will find the step-by-step process you must follow in order to apply for this regime:

  • Download form 030. You can find it here.
  • Submit it to the Tax Agency, something you can do online.
  • Once you receive the approval from the Spanish Tax Authorities, you will have to send another application form, form 149.
  • In addition to this form, in this final phase, you must include your passport (complete), NIE, employment contract, and social security number
  • Finally, in a period of 10 days according to the law (although usually, the process can take up to 1-2 months), you will receive the final acceptance together with a certificate that you must hand it in to the company you work for so that they can start applying this tax rate deduction.

Keep in mind that once this regime is applied to you, every year (from April to June) you will have to file your income tax return using form 151.
